Each practice below stands on its own, but most engagements draw on two or all three. The lists are representative rather than exhaustive; if the matter concerns a distressed property or a dispute arising from one, it is likely within our experience.

Restructuring and bankruptcy advisory

The loan has defaulted, or is about to. The lender's letter cites the default rate, the acceleration clause and the guaranty. This is the moment the borrower's options are widest and most often wasted.

We begin with the documents and the numbers: the note, the mortgage, the guaranties, the rent roll, the operating history and the collateral's actual value. From there we develop a workout proposal grounded in what the property can support, and we negotiate it with the loan officer, the special servicer or the note buyer on the other side.

When a consensual workout is not available, we evaluate Chapter 11 alongside the alternatives. It is one tool among several, and whether it serves a particular property depends on the loan, the collateral and the posture of the case. Where it is the right tool, we help counsel structure the filing, prepare the schedules and budgets the court will demand, and serve as chief restructuring officer or plan administrator so that a creditor cannot argue the debtor is unmanaged. We have also worked the other side of the table, analyzing and opposing debtor plans on behalf of secured creditors.

Real estate services

Amerevision repositions and operates real estate for clients whose assets are over-leveraged, under-managed or tied up in litigation. The same experience that lets us negotiate a workout lets us value a distressed asset accurately, and the same operating capability that stabilizes a debtor's property lets us carry a business plan through to a refinance or a sale.

We manage construction and renovation directly, including large-scale repair and restoration programs, and we oversee day-to-day operations where a receiver, a lender or a court needs a property run competently during a dispute. In Florida the practice extends to commercial buildings, hotels and other development projects.

Forensic review and analysis

A foreclosure judgment is, in the end, a number. So is a deficiency claim, a partnership buyout and a damages award. Our forensic work exists to establish that number, and to give the attorney presenting it a witness who can defend every line.

We reconstruct loan histories from the original closing forward, test the charges against the loan documents and applicable law, and trace funds through partnerships and operating companies where ownership or distributions are disputed. We prepare the analysis in a form counsel can use at mediation, at summary judgment and at trial, and we consult on the financial strategy of the case as a whole.

Litigation funding

Some disputes are worth pursuing and cannot be afforded. For property owners and businesses with a strong claim or defense arising from real estate, Amerevision funds the legal fees and costs of the case in exchange for an agreed share of the recovery or the savings achieved. The funding is non-recourse: repayment comes from the outcome, not from the client.

We work with the client's attorney throughout, and we stay involved, contributing the same forensic and restructuring analysis we bring to our advisory work, because a funder who understands the property is worth more to the case than one who only writes the check.
